EXEMPTION FROM LEGAL LIABILITY

We, Focus Engenharia Elétrica LTDA, a private legal entity, registered with the CNPJ under number 03.087.779/0001-12, with headquarters at Rua Marechal Hermes da Fonseca, 501 Jardim Laudissi I Santa Bárbara d'Oeste/SP Brazil - P.O. Box 13450-360, hereinafter referred to as "Focus Engenharia", collect and use personal data belonging to those who use our website. In doing so, we act as the controller of this data and are subject to the provisions of Federal Law No. 13.709/2018 (General Data Protection Law – LGPD).

We care about protecting your personal data and, therefore, we provide this privacy notice, which contains important information about:

  • What data do we collect and what do we do with it?

  • Its purposes and the legal basis that justifies the processing;

  • Who your data may be shared with;

  • Your rights regarding your personal data; and

  • How to contact us.

  • We acknowledge the need for the protection and proper management of personal information collected on our website, as well as information shared with us by our clients. This Privacy Notice will help you understand the types of information we may collect, how such information may be used, with whom it may be shared, and the rights of data subjects regarding the protection of their personal data.

  • Contact and Quote Request Forms: We collect data voluntarily provided by users when filling out forms on our website to request a quote or further information. This data includes: First Name, Last Name, Email, Telephone, Company Name, and Job Title.

    Customer Service Channels: Users may contact us via telephone, email, or messaging applications (such as WhatsApp). Personal data is collected for the purpose of identifying the user and addressing their request. We collect data provided spontaneously, such as name, email, and telephone number.

    Cookies: Personal data may be collected through cookies. For more information, please consult our Cookie Policy.

    Contract Performance: In the event that our electrical engineering services are contracted, we will collect additional data necessary for contract drafting, service provision, and compliance with legal and fiscal obligations (such as billing information, data on legal representatives, etc.).

  • Focus also uses Social Media (such as LinkedIn, Instagram, etc.) to communicate and interact with its clients and the public. These third-party websites are Internet-based technologies that are not operated or controlled by Focus. By interacting with us through these platforms, you may disclose certain personal information, which will be subject to the privacy policies of the respective platforms.

  • Focus processes personal data strictly for the purposes described below, supported by the following legal bases of the LGPD (Brazilian General Data Protection Law):

    Drafting and executing contracts for the provision of electrical engineering services.

    Complete registration information (Name, CPF [Brazilian tax ID], RG [Brazilian national ID], Address, etc.) and financial information.

    Contract Execution (Art. 7, V).

    Fulfillment of legal obligations, such as issuing invoices, collecting taxes, or issuing Technical Responsibility Notes (ART) with CREA.

    Registration and financial data.

    Compliance with a legal or regulatory obligation (Art. 7, II).

    By filling out the "Request a Quote" form and checking the corresponding box, the user provides their explicit consent for the purposes of sending the Newsletter and inclusion in the Focus Database, in addition to requesting the preliminary procedures for the quote.

    Users can unsubscribe from our marketing communications at any time by clicking the unsubscribe link in the footer of the emails themselves.

  • Focus does not practice the disclosure, sale, or renting of information that may identify the data subject. Your data is for the exclusive internal use of the organization to fulfill the purposes outlined in the previous section.

    Data may be shared with third parties only under the following conditions:

    • Service Providers: With suppliers and partners who assist in Focus's operations, such as marketing automation and email delivery platforms (for newsletters), website hosting services (IT), accounting services, and legal advisors.

    • Public Authorities: To comply with applicable legislation, such as issuing invoices (Municipality/City Hall) or registering projects (e.g., CREA).

    • Legal Obligation or Court Order: Pursuant to a judicial decision or request from government regulatory authorities.

    • Corporate Transactions: In the event of a merger, acquisition, or sale of Focus assets, data may be transferred to the successor organization.

    We require that all third parties and service providers maintain the confidentiality of the information and use it strictly for the purposes for which they were contracted.

  • Under the terms of the LGPD, the data subject has the following rights:

    • Confirmation of the existence of processing;

    • Access to the data;

    • Correction of incomplete, inaccurate, or outdated data;

    • Anonymization, blocking, or elimination of unnecessary or excessive data, or data processed in non-compliance with the LGPD;

    • Portability of data to another service provider;

    • Elimination of personal data processed with the data subject's consent;

    • Information regarding the sharing of personal data;

    • Information regarding the possibility of refusing consent and the consequences of such refusal;

    • Revocation of consent.

    Focus will evaluate the best way to fulfill requests to exercise any of your rights. However, Focus may decline to fulfill a request, in whole or in part, in specific situations provided for by law (such as to comply with a legal obligation or to safeguard Focus's rights).

    For security reasons, in order to exercise your rights, we may request additional data or information to confirm the identity and authenticity of the data subject.

  • We store and retain your information: (a) for the time required by law; (b) until the end of the processing of personal data (e.g., when the purpose is achieved); or (c) for the time necessary to safeguard Focus's rights (including limitation periods).

    In cases where the processing of personal data is terminated, except in cases established by applicable legislation, the personal data will be deleted.

  • Focus provides below the contact details for the Data Protection Officer (DPO), who is responsible for addressing any and all requests from data subjects or the National Data Protection Authority (ANPD).
     

    If, despite our commitment and efforts to protect your data, you believe that your data protection rights have not been met, we request that you contact our DPO. The data subject also has the right to file a complaint directly with the ANPD.

  • Focus reserves the right to update or modify this Notice at any time without prior notice. However, we will always publish the new revised version on our website.
